A few words regarding SCOTUS' Obamacare Ruling


So The Obamacare Individual Mandate has been determined to be a Tax, by a majority Supreme Court Ruling.
Here are a couple of points of contention followed by a few points of view:

1. The Obamacare Tax is Unconstituitonal because it IS NOT a uniform tax.

"The Congress shall have Power To lay and collect Taxes, ... but all Duties, Imposts and Excises shall be uniform throughout the United States..." U.S. Constitution - Article 1, Section 8.

2. Under the Tax Anti-Injuction Act, the Court would actually be prohibited to hear the case at all until the "tax" is actually imposed, which won't be for another couple of years.  Therefore, SCOTUS should not have heard or rendered a ruling under the premise that the Obamacare Individual Mandate was a tax.  SCOTUS broke the law.

The Tax Anti-Injunction Act of 1867, currently codified at 26 U.S.C. § 7421(a), states "No suit for the purpose of restraining the assessment or collection of any tax shall be maintained in any court by any person, whether or not such person is the person against whom such tax was assessed." 

Other than the obvious that the vast majority of the Federal Government is so far removed from the Constitution as intended by our Founders, at least the repeal of Obamacare CANNOT be filibustered because of the same reconciliation procedure the Obama Congress used to ram it down our throats pass it.  Looks like the sword cuts both ways!

But none of this really matters though, because as long as we cast our vote based on party affiliation vs. principle, NOTHING will change.

If the majority of Americans want Obamacare gone and the Federal Government to be stuffed back into the confines of the Constitution, a Presidential, Congressional, or Senatorial election based on warm fuzzies in your belly or the lesser of two evils WON'T change a thing.  However, the results of such elections, based on the truth, historical education, and relentless political engagement, WILL.  The key is YOU!  It's just that simple!

You have to ask yourself, are you going to get lulled back into the slumber of apathy and disenfranchisement, or are you actually going to do something about it?!  QUESTION: How are are the freest citizens in the history of the world?  Did you think that just happened because of the mere fact we call ourselves Americans?  What has made our country exceptional?  ANSWER: Our freedom IS NOT free, and the only way to keep it is to trade our time, involvement, and efforts to our elected in government (of all levels) to ensure that the direct end of ALL government is our Liberty.

What you see now in America is a reflection of the opposite of YOUR involvement as free citizens!  And this didn't happen overnight!
