***Floridian Alert: Florida's 1st Bill to the floor - Health Care Freedom Act

State Rep. Scott Plakon, R-Longwood, has re-filed a constitutional amendment that would attempt to prevent Floridians from being penalized if they don’t buy health-care coverage to comply with the federal health care reforms.
Although it is unclear legally how such an amendment would interact with the federal health-insurance mandates Congress passed and a state judge tossed the same language off the 2010 ballot, House Joint Resolution 1 has already picked up a prime sponsor in the Florida Senate: President Mike Haridopolos, R-Merritt Island.

“It demonstrates from the Senate side that they take this very seriously,” Plakon said. Haridopolos is widely believed to be considering a run for the U.S. Senate against Democratic Sen. Bill Nelson in 2012, and the amendment also would allow him to champion the health-care issue in such a contest.
The “Health Care Freedom Act” as it was known earlier this year, was passed by the Legislature last April, but thrown off the ballot over the summer because a state judge ruled it was misleading and could confuse voters. Among the claims Judge James Shelfer found problems with were pledges to “ensure access to health care services without waiting lists, protect the doctor/patient relationship,” and ”guard against mandates that don’t work.”
Plakon said those 20 words have been removed from the new version of the amendment, which lawmakers could consider in the spring 2011 session. If passed, the amendment would go to voters in 2012.
